Which Countries Should You Register In?

When registering a trademark, you may wonder which country you should register with.  It is important that you register your trademark with any country or jurisdiction where you are going to offer services or products under the trademarked name.  At this point, you should note that certain countries will have requirements for registering a trademark and you need to know what these are. 

Are There Trademark Registrations That Cover More Than One Country?

There are several international agreements that make it possible to file a single trademark application which registers the trademark in more than one country.  One of these registrations is the Benelux registration which offers trademark protection across the Benelux countries of Belgium, the Netherlands and Luxemburg.  

Another system that you should know about is the EUTM or European Union Trade Mark which offers protection across the EU with a single application. 

 

What Is The Madrid System?

The Madrid System is important because it is the system used for the international registration of trademarks.  The system is governed by 2 different international treaties and they are the Madrid Protocol and the Madrid Agreement.  Both of these treaties are administered by the International Bureau of the World Intellectual Property Organization.  It is important to note that this agreement will only cover countries that have signed up to it, so you will have to research if the country you want the trademark in is covered.
